Answer

What are the ASIC Market Integrity Rules (Securities Markets)?

They are ASIC-made rules using the Corporations Act 2001 power in section 798G and bind participants in Australian securities markets. They cover supervision, client money, best execution, records, order handling, automated trading controls and manipulation. The 2026/574 instrument amends the 2017 set, mainly in Part 5.6.

The Securities Markets rules of 2017 are a legislative instrument made by ASIC using the Corporations Act power in subsection 798G(1). They are not guidance. They bind Market Participants and Trading Participants in the securities markets they cover, and a contravention can be dealt with as a civil penalty matter or through the Markets Disciplinary Panel.

What do the rules cover?

The instrument is organised by chapter. The chapters that matter most to a participant are supervision and representatives, client relationships and best execution, records, trading conduct and Crossing Systems, transparency and regulatory data, and operational resilience. The rules sit alongside the Corporations Act and the operating rules of each market; they do not replace either.

What does the 2026/574 instrument change?

Amendment Instrument 2026/574 makes 109 changes to the 2017 rules. The largest is the replacement of the Automated Order Processing regime in Part 5.6 with a Trading System requirements regime. It also repeals the Designated Trading Representative regime in Part 2.5, adds monitoring and algorithm governance duties, rewrites the client and own-account record rules, and replaces references to Chi-X with TMX.

Who is bound?

The duties in this record attach to a Market Participant or a Trading Participant, depending on the rule. A fund manager that is neither is outside the duties, but the participant it uses is bound. A firm that operates its own trading technology but is not a participant should confirm its status before assuming the rules do not reach it.

When does the amended text apply?

On 17 March 2028. Rule 2 sets commencement eighteen months from the registration date, and the authorised version records registration on 17 September 2026. Until then the current compilation applies. The free check shows the status for any date you choose.

What should a participant read first?

Start with Rule 5.5.1 and Part 5.6 for the systems work, Rules 4.1.1 to 4.1.9 for the record work, and Rules 5.7.1 and 5.7.2 for the conduct work. Each has a page in this record with the evidence an auditor asks for.
