Answer

When does Amendment Instrument 2026/574 commence?

It commences on 17 March 2028. Rule 2 sets commencement eighteen months from the registration date on the Federal Register. The authorised version records registration on 17 September 2026, and eighteen months later is 17 March 2028. Before that date the current 2017 rules apply.

The instrument does not print a calendar date. Rule 2 measures commencement as eighteen months from the date the Federal Register records registration. The authorised version of F2026L01223 records "registered 17/09/2026" on each page. Eighteen months after 17 September 2026 is 17 March 2028.

Why is the date calculated rather than quoted?

Because the instrument uses a period, not a date. A reader who quotes 17 March 2028 without the registration date has skipped the step that proves it. A later instrument could change the commencement, and the instrument was tabled on 12 October 2026 and is open for disallowance, so the date should be re-checked against the register and against any later amendment.

What applies before that date?

The current compilation of the 2017 rules applies, including the Automated Order Processing regime and the Designated Trading Representative regime. The amended text is a planning record. A firm that applies the amended duties early is not necessarily wrong, but it should not describe the amended text as the current legal requirement.

What work should start before commencement?

The long items are the record schema, the representative authorisation register, the algorithm inventory, the control tests and the certification packs. The instrument gives 18 months, which is enough to run an Initial Certification Review and a Material Change Review in a realistic environment, but not enough to leave the record redesign to the last quarter.

How does the free check treat the date?

It takes the date you enter and returns one of two states: the current text applies, or the amended text applies. It does not average them or assume the later text is already in force. On the commencement date itself, the amended text applies.
