The requirement, in our words

Ahead of putting a Trading System into use in a Market, a Trading Participant must give ASIC a written Initial Certification containing the matters in subrule (2), and receive ASIC written confirmation that it complies. The content includes the participant name, the system version and name, the Market, whether the system permits a client to enter Orders into the participant system, a statement whether the Initial Certification Review was performed, a statement whether the resources, arrangements and controls, organisational and technical, meet the standards in 5.5.2 together with 5.6.3, and a statement by at least one responsible officer that the information in (a) to (f) is accurate, with the officer name, position and date. The old two director signature requirement is repealed.

What the rule is trying to do

The certification is the participant attestation to ASIC. The new content is narrower and more operational than the old AOP certification: it asks about client order entry, the review, the resources and the controls, and it puts the accuracy statement on a responsible officer rather than two directors. The ASIC confirmation remains a condition of use.

What good practice looks like

Build a certification pack that maps each paragraph to the supporting evidence. Confirm the system version and the Market. Record whether clients can enter Orders directly. Attach the completed Initial Certification Review. Obtain the responsible officer statement with name, position and date. Track the ASIC confirmation and do not treat the send as the approval.

What changed in the instrument

Items 72 to 77 replace the heading, remove AOP language, replace paragraphs (c) to (e) with new (c) to (g), and repeal subrule (3). The two director signature is replaced by at least one responsible officer statement.

Common gaps

  • The pack still uses the old AOP certification form and the two director signatures.
  • The client order entry question is answered without checking the actual entitlement.
  • The responsible officer signs without a documented verification.
  • The ASIC confirmation is not tracked, and the system goes live on the sent date.

What to do before 17 March 2028

  1. Rewrite the certification template to the new (a) to (g) content.
  2. Map each answer to evidence from the Initial Certification Review.
  3. Confirm the client order entry position from the system.
  4. Record the responsible officer statement and track the ASIC confirmation.
