The requirement, in our words

A Trading Participant must, if ASIC directs in writing, supply a further certification covering a Market. The certification must come from a qualified person ASIC accepts and must address compliance with the Trading System Requirements for that Market. The participant must comply by the deadline in the direction. The rule replaces the old Rule 5.6.11.

What the rule is trying to do

The power is a targeted assurance tool. The conditions are procedural: a written direction, a person acceptable to ASIC, the right subject matter, and the deadline in the direction. A firm that has no standing arrangement for an acceptable independent reviewer will lose time.

What good practice looks like

Keep a short list of appropriately qualified reviewers and their independence and competence evidence. Write a response plan that starts when a direction arrives: confirm the scope, confirm the reviewer with ASIC, set the evidence pack and diarise the deadline. Do not wait for the direction to identify a reviewer.

What changed in the instrument

Item 78 inserts the new Rule 5.6.7 after Rule 5.6.6. Item 82 repeals the old Rule 5.6.11. The substance moves, but the new rule uses Trading System Requirements and the new numbering.

Evidence an auditor or ASIC asks for

CategoryRecord to keepRetention
Reviewer panelA panel of appropriately qualified reviewers with competence and independence evidence, kept ready before a direction.Current.
Direction recordThe written ASIC direction, the scope, the deadline and the nominated reviewer.Seven years.
CertificationThe further certification provided, with the reviewer basis and the evidence pack.Seven years.
TimelineThe dated steps from receipt to submission, showing compliance within the time specified.Seven years.

Common gaps

  • The firm has no pre-approved independent reviewer.
  • The direction is treated as a request for information rather than a certification.
  • The deadline is diarised but the evidence pack is assembled after it.
  • The certification is signed by someone the firm has not shown to be acceptable to ASIC.

What to do before 17 March 2028

  1. Build the reviewer panel and keep the evidence current.
  2. Write the direction response plan with roles and dates.
  3. Test the plan with a tabletop direction.
  4. Record the reviewer acceptance step with ASIC.
